Q. 1. What parts of the Port Phillip Planning Scheme will be affected?
The changes will be implemented through Amendment C62 to the Port Phillip Planning Scheme. The main changes are to update the Local Planning Policy Framework (LPPF) section of the Planning Scheme. The LPPF is made up of (i) the Municipal Strategic Statement (Clause 21) that sets out the vision and policy statements around sustainability, land use, built form, and neighbourhoods; and (ii) the Local Planning Policies section which proposes the addition of four new policies re Non-Residential Uses in Residential Zone; Backpackers' Lodges, Caretaker's Dwellings; and Subdivisions. The amendment also introduces a mandatory 5% public open space requirement through the Schedule to Clause 52.01 - Public open space contribution and subdivision.
Q. 2. What are the key changes in the proposed amendments?
Promoting environmentally sustainable design and development and sustainable transport.
Providing clear direction on where housing growth will go, balanced with the protection of heritage and neighbourhood character in established residential areas.
Providing greater definition of the role and function of each activitiy centre to guide future use and develpment
Strategies for ensuring Port Phillip's open space network can respond to the needs of a growing population. A requirement (Clause 52.01) for a mandatory 5 per cent open space contribution is proposed for subdivisions to support the open space policy in the MSS.
Considering and managing the impacts of licensed premises and late night entertainment uses
Considering the social impacts of large scale housing developments, licensed premises and gaming venues
There are no changes to any zonings, overlays (such as the heritage overlay) or other controls in the planning scheme.
Q. 3. Why do we need new policies?
Council is required to review its planning scheme under State Government legislation. The current planning scheme became law in 1999 and whilst some minor changes have been made, there has not been an overall review. It is important to make sure the planning scheme is up to date and reflects the current Council Plan and related strategies that have been develped in consultation with the community.
Q. 4. How can I give feedback on the proposed amendments?
There are many ways you can make a submission. It is a legislative requirement that submissions regarding the proposed amendments be made in writing. You can:
- Download a Word version of the submission form and mail it.
- Fill out the on-line submission form and lodge it on-line.
- Send a letter or an email.
- The on-line submission form has a limited space for comments. If you wish to write a detailed submission, a different format should be used.
You do not need to fill out the formatted submission form, but your submission should include the following:
- the amendment number - C62
- your views on the amendment and proposed changes
- explain what you would like Council to do - be as specific as you can about the changes you would like to see made.
- your name and address and daytime contact details so you can be contacted. If you are making a submission jointly with a number of people, please nominate one person as the group's representative for correspondence.
The closing date for submissions is 12 April 2010.

Q. 6. Who can I talk to about the Planning Scheme?
You can talk to one of Council's strategic planners by calling ASSIST on 9209 6777. Council's planning staff will be out in the community in February and March to answer questons about the amendments.
